Whiplash Claims
Whiplash is the most common injury sustained in road traffic accidents in the UK. If you’ve suffered whiplash in an accident that wasn’t your fault, you could be entitled to compensation — even for minor injuries.
What Is Whiplash?
Whiplash is a neck injury caused by a sudden, forceful movement of the head — typically backwards and forwards. It commonly occurs in rear-end collisions but can result from any type of road traffic accident.
Common Symptoms
- Neck pain and stiffness
- Reduced range of motion in the neck
- Headaches, often starting at the base of the skull
- Shoulder pain or tenderness
- Tingling or numbness in the arms
- Fatigue and difficulty concentrating
- Dizziness
Symptoms may appear immediately after the accident or develop over the following 24–48 hours. If you haven’t yet seen a doctor, you should seek medical attention as soon as possible — your medical records form a key part of your claim.
How Much Is a Whiplash Claim Worth?
The amount of compensation you receive depends on the severity of your injury and how long it takes to recover. Awards are split into two categories:
| Severity | Typical Compensation | Recovery Time |
|---|---|---|
| Minor (full recovery within 3 months) | £240 — £4,500 | Under 3 months |
| Moderate (recovery 3 months — 2 years) | £4,500 — £15,000 | 3 months — 2 years |
| Severe (long-term symptoms) | £15,000 — £45,000+ | 2+ years |
You can also claim for financial losses caused by the accident:
- Lost earnings (time off work)
- Medical costs and prescriptions
- Travel costs to medical appointments
- Vehicle damage and repair costs
- Care and assistance costs
The Whiplash Injury Regulations 2021
Since May 2021, whiplash claims from road traffic accidents are handled under a new tariff-based system for injuries lasting up to two years. The tariff sets fixed amounts depending on how long symptoms last:
| Duration | One injury tariff | Two+ injuries tariff |
|---|---|---|
| Up to 3 months | £240 | £260 |
| 3 — 6 months | £495 | £520 |
| 6 — 9 months | £840 | £895 |
| 9 — 12 months | £1,320 | £1,390 |
| 12 — 15 months | £2,040 | £2,125 |
| 15 — 18 months | £3,005 | £3,115 |
| 18 — 24 months | £4,215 | £4,345 |
For more serious injuries or where symptoms last more than two years, the standard personal injury compensation brackets apply, and claims are often worth considerably more.
